١. قبول الشروط
باستخدامك تطبيق فلك فإنك تُقرّ بأنك قرأت هذه الشروط وفهمتها ووافقت على الالتزام بها. تُلتقط موافقتك عند إنشاء الحساب، وقد يُطلب منك إعادة الموافقة عند إجراء أي تغييرات جوهرية على الشروط.
٢. وصف الخدمة
فلك مساعد ذكي يساعدك على حفظ الملاحظات والفواتير والمنتجات والأفلام والمستندات والمهام، وإنشاء تذكيرات زمنية ومتكررة وتذكيرات مبنية على المواقع، واستذكار المعلومات من محادثاتك السابقة وعناصرك المحفوظة، واستخدام الإملاء الصوتي، ومزامنة الحالة بين أجهزتك، والاشتراك في خطة فلك بلس.
٣. الأهلية
يجب أن يكون عمرك ١٣ عاماً أو الحد الأدنى لسن الموافقة في بلدك، أيهما أعلى. فلك ليس موجهاً للأطفال ولا يجمع بيانات منهم عن قصد.
٤. الحساب والمصادقة
يمكنك تسجيل الدخول عبر Apple أو Google أو البريد الإلكتروني مع كلمة مرور لا تقلّ عن ١٥ حرفاً. أنت مسؤول عن الحفاظ على سرية بيانات اعتمادك وعن جميع الأنشطة التي تتم من خلال حسابك. تتم المصادقة عبر Supabase.
٥. محتوى المستخدم والترخيص
أنت تملك المحتوى الذي تنشئه أو تحفظه في فلك. وبموجب هذه الشروط، تمنح فلك ترخيصاً محدوداً وغير حصرياً ومعفياً من الإتاوات لتخزين محتواك ومعالجته ونقله لغرض وحيد هو تشغيل الخدمة لك.
٦. معالجة الذكاء الاصطناعي ومزودو الخدمة
تُحال النصوص التي ترسلها، والعناصر التي تحفظها، والصور والمرفقات التي ترفعها، والنصوص المملاة صوتياً، وبيانات المواقع المحفوظة، ومقتطفات الذاكرة المستذكرة إلى OpenAI لتخطيط ردود المساعد واستخراج النصوص من الصور وإنشاء المتجهات الدلالية للذاكرة. وتُستخدم Supabase وVercel وApple وGoogle في الأدوار التشغيلية الموضّحة في سياسة الخصوصية. ناتج الذكاء الاصطناعي احتمالي وقد يخطئ في التواريخ والأماكن والأسعار والنصوص المستخرجة، لذا تحقّق دائماً من التذكيرات والفواتير المهمة قبل الاعتماد عليها.
٧. الاستخدام المقبول
يُمنع إساءة استخدام المساعد، أو محاولة الوصول غير المصرّح به إلى أنظمة فلك، أو رفع محتوى ضار أو غير قانوني أو ينتهك حقوق الآخرين، أو استخدام الخدمة للتحرّش بالآخرين، أو حصاد البيانات، أو الهندسة العكسية فيما يتجاوز ما يسمح به القانون المحلي.
٨. الاشتراكات والفوترة والاسترداد
اشتراك فلك بلس بسعر ١٩٫٩٩ ريالاً سعودياً شهرياً عبر متجر تطبيقات Apple. تخضع التجديدات والإلغاءات والاستردادات لسياسة متجر تطبيقات Apple. لا توجد عمليات استرداد منفصلة خارج تلك القناة. يمكنك إدارة الاشتراك أو إلغاؤه من إعدادات حساب Apple على جهازك.
٩. الإنهاء
يمكنك حذف حسابك في أي وقت من إعدادات التطبيق، ويؤدي ذلك إلى حذف ملفك الشخصي وعناصرك وتذكيراتك ومرفقاتك وذاكرتك ومواقعك المحفوظة. يجوز لفلك تعليق أو إنهاء حسابك في حالات إساءة الاستخدام أو المخاطر الأمنية أو الامتثال للقانون.
١٠. إخلاء المسؤولية
تُقدَّم الخدمة "كما هي" و"حسب توفّرها" دون أي ضمانات صريحة أو ضمنية، بما في ذلك ضمانات قابلية الاستخدام أو الملاءمة لغرض معيّن أو دقة ناتج الذكاء الاصطناعي. ناتج الذكاء الاصطناعي ليس استشارة مهنية (قانونية أو طبية أو مالية أو متعلقة بالسلامة)، ولا ينبغي الاعتماد عليه كبديل عنها.
١١. حدود المسؤولية
إلى أقصى حد يسمح به القانون، تقتصر المسؤولية الإجمالية لفلك تجاهك عن أي مطالبة ناشئة عن أو متصلة بالخدمة على القيمة الأكبر من: (أ) الرسوم التي دفعتها لفلك خلال الاثني عشر شهراً السابقة للحدث، أو (ب) ١٠٠ ريال سعودي. لا تتحمل فلك أي مسؤولية عن الأضرار غير المباشرة أو العرضية أو التبعية أو العقابية أو فقدان الأرباح أو فقدان البيانات.
١٢. التعويض
توافق على تعويض فلك والدفاع عنها وإبراء ذمتها من أي مطالبات أو خسائر تنشأ عن محتواك أو إساءة استخدامك للخدمة أو انتهاكك لهذه الشروط أو لحقوق طرف ثالث.
١٣. القانون الحاكم وحل النزاعات
تخضع هذه الشروط لقوانين المملكة العربية السعودية وتُفسَّر وفقاً لها. تُحلّ النزاعات في المحاكم المختصة بمدينة الرياض. يجب على الطرفين بذل جهد معقول لتسوية أي نزاع ودياً قبل اللجوء إلى الإجراءات الرسمية.
١٤. تعديل الشروط
يجوز لفلك تحديث هذه الشروط من وقت لآخر. تستوجب التغييرات الجوهرية إعادة الموافقة عبر بوابة التطبيق قبل المتابعة. يُعدّ استمرار استخدامك للخدمة بعد التعديلات غير الجوهرية موافقةً على الشروط المحدّثة.
١٥. الفصل والاتفاقية الكاملة
إذا تبيّن أن أيّ بند من هذه الشروط غير صالح قانونياً أو غير قابل للتنفيذ، تظل البنود الأخرى سارية بكامل قوتها. تشكّل هذه الشروط مع سياسة الخصوصية الاتفاقية الكاملة بينك وبين فلك بشأن استخدامك للخدمة.

1. Acceptance of Terms
By using Falik you confirm that you have read, understood, and agreed to be bound by these Terms. Your agreement is captured when you create your account, and you may be required to re-accept if we make material changes to these Terms.
2. Service description
Falik is an assistant that helps you save notes, bills, products, movies, documents, and tasks; create time-based, recurring, and location-based reminders; recall information from your past conversations and saved items; use voice dictation; sync state across your devices; and subscribe to the Falik Plus plan.
3. Eligibility
You must be at least 13 years old, or the minimum age of consent in your country, whichever is higher. Falik is not directed to children and does not knowingly collect data from them.
4. Account and authentication
You can sign in with Apple, Google, or an email address with a password of at least 15 characters. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Authentication is processed by Supabase.
5. User content and license
You own the content you create or save in Falik. You grant Falik a limited, non-exclusive, royalty-free license to store, process, and transmit your content for the sole purpose of operating the service for you.
6. AI and service-provider processing
Text you send, items you save, photos and attachments you upload, voice-dictated text, saved-place metadata, and recalled-memory excerpts are transmitted to OpenAI for assistant planning, text extraction from images, and embedding generation. Supabase, Vercel, Apple, and Google are used in the operational roles described in the Privacy Policy. AI output is probabilistic and can misread dates, places, prices, or extracted text — always verify important reminders and bills before relying on them.
7. Acceptable use
Do not abuse the assistant, attempt unauthorized access to Falik systems, upload harmful or illegal content or content that infringes others' rights, use the service to harass others, scrape data, or reverse-engineer beyond what local law allows.
8. Subscriptions, billing, and refunds
Falik Plus costs 19.99 SAR per month and is sold through the Apple App Store. Renewals, cancellations, and refunds are governed by Apple App Store policy. There are no separate refunds outside that channel. You can manage or cancel your subscription from your Apple Account settings on your device.
9. Termination
You can delete your account at any time from in-app settings; this removes your profile, items, reminders, attachments, memory, and saved places. Falik may suspend or terminate your account for abuse, security risk, or legal compliance reasons.
10. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of AI output. AI output is not professional advice (legal, medical, financial, or safety-related) and should not be relied on as a substitute for it.
11. Limitation of liability
To the maximum extent permitted by law, Falik's aggregate liability to you for any claim arising out of or relating to the service is limited to the greater of (a) the fees you paid to Falik in the 12 months preceding the event, or (b) 100 SAR. Falik is not liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits or data.
12. Indemnification
You agree to indemnify, defend, and hold Falik harmless from any claims or losses arising out of your content, your misuse of the service, or your violation of these Terms or any third-party rights.
13. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Disputes will be resolved in the competent courts of Riyadh. The parties will make a reasonable effort to settle any dispute amicably before initiating formal proceedings.
14. Changes to the Terms
Falik may update these Terms from time to time. Material changes will require re-acceptance through the in-app gate before you can continue using the service. Continued use after non-material changes constitutes acceptance of the updated Terms.
15. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Falik regarding your use of the service.
